Code amendments to remove content-based language from the Sign Code and make housekeeping and minor policy changes to Titles 12 (streets), 14 (signs), 17 (land division), and 19 (zoning) of the Milwaukie Municipal Code. The most significant amendments were to the City's Sign Code, revisions to which focused on meeting new legal standards for how a City may regulate signs.

the adopted amendment. The Milwaukie City Council adopted the 2007 City of Milwaukie Transportation System Plan (TSP) as an ancillary document to the City's Comprehensive Plan. The 2007 TSP replaced the 1997 TSP. An introduction to and summary of the 2007 TSP replaced the existing text in the Transportation Element of Chapter 5 of the Comprehensive Plan. The 2007 TSP contains the City's long-term transportation goals and policies for pedestrians, cyclists, drivers, transit users, and freight carriers. It provides for the coordination of transportation improvements at the local level and the integration of the local transportation system with the regional transportation system. It also identifies the issues, policies, and projects that are important to the community.

The Milwaukie City Council adopted zoning code amendments (housekeeping amendments) in order to clarify specific subsections of Title 14 and Title 19 of the Code (see Attachment 1, Exhibit B). All of the proposed changes are designed to: Reduce conflict between regulations within the Zoning Code or with other sections of the Milwaukie Municipal Code; clarify language that makes understanding and implementing the regulation difficult; and change incorrect references to other sections of the Milwaukie Municipal Code.

The adopted amendments make the local flood hazard regulations codified in Milwaukie Municipal Code Title 18 (Flood Hazard Regulations) and Title 19 (Zoning Code) consistent with federal regulations. The adopted changes are in response to the most recent update of the Flood Insurance Rate Maps by FEMA.

Milwaukie City Council adopted an ordinance that annexed two properties into the City of Milwaukie that are located on SE Harmony Road between SE Lake Road and SE Railroad Avenue. Prior to annexation, both properties were within the City's urban growth management area and were contiguous to the existing city limits. Upon annexation, a land use designation of Industrial (I) and a zoning designation of Business Industrial (Bl) was applied to both properties.

The adopted amendments modify the City's Zoning Map and Comprehensive Plan Map #4 (Historic Resources), as well as the City's Historic Resources Property List (Appendix 1 to the Comprehensive Plan). The modifications remove the "contributing historic resource" designation from the existing school building at 8950 SE 36th Avenue (Ardenwald Elementary School) because it has been approved for demolition and will be replaced with a new, larger building. The adopted amendments reflect this change in historic resource status.

The City of Milwaukie amended the following sections of its Municipal Code: Chapter 19.1400 Public Facility Improvements; Chapter 19.400 Supplementary Development Regulations; Chapter 19.300 Use Zones; Chapter 19.100 Introductory Provisions; and, Title 17 Land Division. Amendments to Chapters 19.1400 and 19.300 contain major policy changes in the way that transportation improvements are exacted from development. Remaining amendments contain minor text additions, deletions, and relocations.

The amendment package significantly modernizes and improves the effectiveness of Milwaukie's land use and development review regulations and procedures. It consolidates existing procedures into one location, improves their efficiency and clarity, and gives the City more tools to use during the land use and development review process. The package includes both zoning code and comprehensive plan text amendments. It also includes a complete restructuring of Title 19 to provide a better vehicle for implementing the proposed improvements to the City's review procedures.

The proposed amendments update the City's Zoning Ordinance and Comprehensive Plan to address Statewide Land Use Planning Goal 6 (Water Quality) and Goal 5 (Natural Resources) as well as Metro Functional Plan Titles 3 and 13. The proposal includes repeal of Zoning Ordinance Section 19.402 (Water Quality Resource Regulations) and replacement with an expanded Section 19.402 Natural Resources, to cover both Water Quality Resources and newly designated Habitat Conservation Areas. The existing natural resource map in the Comp Plan will be replaced with an updated map, and a new map will be established for administering the related zoning regulations. Related definitions in Section 19.201 were also updated, and various other chapters in the Zoning Ordinance will be revised to be consistent with the new Section 19.402.
