Abstract

The historic preservation field is often perceived a being antagonistic towards private property rights, leading some property owners to oppose official designation of their property on local, state or national registers. As the Oregon Statewide Planning Goal mandate local governments to protect historic resources, prope1ty owners are often apprehensive of potential restrictions being placed on their property right as a result of historic designation. This trepidation is particularly the case in instance where local guideline are vague or appear quite demanding. The conflict between preservation and property right me1its further research to determine the underlying factor that lead to these polarized positions and the role of varying interpretations of the Oregon law in each situation. This thesis will investigate case studies of failed historic district nomination in the State of Oregon to understand the nature of this tension and to formulate initial recommendation to mitigate such conflicts in the future.
